Reviewing and criticizing the Qur'anic proofs of prohibiting women's judgment in jurisprudence

Abstract

In Islam, the principle in assignments, duties and qualifications is gender sharing and no difference between men and women; Because the subject of many assignments and tasks is to have intelligence and ability that women and men share. However, in terms of tasks, the rights and duties of women and men are different. In the discussion of judgment, there is also the question of whether this duty is one of common or one of dispute. Since the Qur'an is the main source of Islamic Sharia, in this research, verses in this context have been described and interpreted, and interpretation and jurisprudential viewpoints have been examined for and against. The research method in this article is descriptive-analytical and the method of collecting information is documentary and library. The findings of this research show that citing the appearance of Qur'anic verses to prohibit women's judgment can be criticized, and the prohibition of women's judgment cannot be attributed to the appearance of Quranic verses, and the Qur'an does not approve of gender discrimination in the position of judge.
