Examining the rule of practice from the perspective of the science of principles

Abstract

The obligee searches for ways in Shari'a rules to actually collect, which is the first way and the surest way is to cut off, but cut off also sometimes takes the title of compound ignorance and does not bring the obligee to reality, from here the issue of practice arises. In this research, first, the concept of rape is discussed, and along with this keyword, the concept of obedience, rebellion, and subjugation, which is always mentioned next to rape, is also discussed. Rape is one of the important topics in theology, jurisprudence and the principles of jurisprudence and has been discussed from different angles. Rape is discussed in the principles of jurisprudence as to whether rape is ugly or not. Based on the assumption of ugliness, does ugliness have a singular subject or does it also have present ugliness? Some believe that the ugliness is a pure subject and the aggressor does not deserve the eagle, and others believe that the aggressor deserves the eagle. In this case, theories have been proposed that the merit of the eagle is due to the ugliness of the act of sin, or another title is given to the merit of the eagle. In this research, after defining rape and its related concepts, various theories on the disgrace of rape have been proposed using descriptive and analytical methods, and in some cases, evidence has also been pointed out, and recently, it has addressed the sayings of contemporary scholars after Sahib Kefayeh.
