Abstract

Resistance and defense against aggression and occupation is one of the topics that, due to its importance in today's societies, should be examined from the perspective of Islamic jurisprudence and international law in order to answer the question that resistance and defense against aggression and occupation are necessary in terms of necessity. How is being allowed and not allowed? The instinctive nature of defense and resistance and its age in the life of human society has attracted the attention of scholars of jurisprudence and law and researchers in these two fields, and numerous research works have been created in this regard, and each of them has dealt with a part of its dimensions that are of importance. The issue of resistance and defense against aggression and occupation is telling. In this research, the resistance and defense against aggression and occupation from the perspective of Islamic jurisprudence and international law have been investigated using descriptive analytical method and library resources. The obligation to resist and fight in the event of an attack on one's self, honor, life, and reputation, as well as the objectivity of the obligation to defend and resist in the event of an enemy attack on the boundaries and loopholes of the Islamic state from the perspective of Islamic jurisprudence; The proof of legitimate defense for governments and the right to self-determination and the permission to rise and fight against colonialists and occupiers for liberation groups and movements, from the perspective of international law, constitute the findings of this research.
