A jurisprudential study of the precedence of women over men in prayer from the perspective of the jurisprudence of the Ahl al-Bayt (a.s.).

Abstract

The issue of women's precedence over men in prayer in the jurisprudence of the Ahl al-Bayt (a.s.) means whether it is permissible for a woman to stand ahead of a man while performing the prayer or whether it invalidates the prayer. This issue is one of the practical jurisprudential issues that has always been of interest to jurists due to its importance in the rules of prayer. The present study examines this issue using a descriptive-analytical method and using reliable jurisprudential and hadith sources and shows that there are two groups of narrations in this regard: a group of narrations considers women's precedence over men permissible, while another group has prohibited it. The findings of the study show that jurists also have different opinions based on these narrations. Early jurists have often considered this practice prohibited; but many later jurists consider it permissible but disliked. A number have also elaborated; That is, if there is a distance or an obstacle between the man and the woman, it is permissible for a woman to take precedence over a man in prayer. Various factors such as the obligation or desirability of prayer, whether it is congregational or individual, the age of the worshippers, whether they are mahram or non-mahram, whether they are in a state of emergency or freedom, and even the place where the prayer is performed (such as in Mecca or outside it) influence the issuance of the final ruling.
